Terms of Use

1. The short version

You create an account, tell us when and where you were born, and answer a questionnaire of 24 statements. With that, Quintessa calculates your birth chart, finds your temperament and, every day, sends you a short tip that crosses the day's transits with you. The basics are free. Quintessa Plus unlocks the full content. We don't sell your data, we don't show ads and we don't promise that a tip will change your day.

That is the spirit. The rest is detail.

2. Who can use it

You can use Quintessa if you:

• are 18 years old or older;
• can enter into a valid contract under Brazilian law;
• give true information about yourself. If your birth date, time or city are wrong, the chart will be wrong.

Quintessa is not for anyone under 18. If we find out an account belongs to a minor, we close it and delete the data.

Your account is personal. Sign in with Apple, Google or email, keep your access secure and tell us if you think someone else used your account.

3. The agreement

By creating an account or using the app, you accept these Terms of Use and the Privacy Policy. If any of that isn't OK with you, don't use Quintessa. If you already created an account, delete it in your Profile and your data will be erased.

These terms change sometimes. When a change significantly affects your rights or obligations, we notify you in the app or by email at least 30 days ahead. Continuing to use the app after that date means you accept it. We keep older versions and email them to you if you ask.

4. What Quintessa offers

Quintessa is an app for iOS and Android that:

• calculates your birth chart from your birth date, time and city: planets, signs, houses, aspects and elements;
• identifies your temperament (sanguine, choleric, melancholic or phlegmatic) through a questionnaire of 24 statements, and lets you adjust the result if you don't recognize yourself;
• sends one tip a day, at the time you choose, and shows the transits that produced it;
• keeps your tip history, with favorites;
• lets you share your result and tips as images;
• lets you export your data and delete your account whenever you want.

Everything works with your own data. We don't compare you with other people or publish rankings. A third personality model, the Big Five, is announced as “coming soon”, which is not a promise of a date or of content.

5. Quintessa Plus: subscription, renewal and cancellation

• The subscription is made inside the app, and billing is handled by the App Store (Apple) or Google Play. We never see or store your card details.
• The plans are monthly and annual. The price, in reais or your country's currency, is the one shown on the purchase screen, straight from the store. The annual plan may include 7 free days. The free period applies once per store account, and if you don't cancel before it ends, billing starts.
• The subscription renews automatically, for the same period and price, unless you cancel at least 24 hours before the end of the current period. The renewal charge is made within 24 hours before the end of the period.
• To cancel, go to your store account settings (Apple: Settings > your name > Subscriptions; Google Play: profile > Payments & subscriptions > Subscriptions). In the app, your Profile has “Manage subscription”, which opens the right page. Deleting the app or deleting your Quintessa account does not cancel the subscription in the store: cancel first.
• If you cancel, Plus continues until the end of the period you already paid for. After that, your account goes back to the free plan and your data stays with you.
• “Restore purchases”, in the app, recovers an active subscription if you switch devices or reinstall the app.
• If the price changes, the store notifies you and, when required, asks for your confirmation before the next charge.

6. Payments and refunds

Because Apple or Google does the billing, refund requests follow the rules and channel of the store where you bought (Apple: reportaproblem.apple.com; Google Play: Google Play Help Center). We support the request and don't oppose refunds the store approves.

Your rights as a consumer remain in force. Under the Brazilian Consumer Protection Code (art. 49), purchases made outside a physical establishment, such as those made on a phone, can be undone within 7 days of the purchase. If you need to, use the store's channel or write to hello@quintessa.me and we will help you route it.

If you were charged twice, charged the wrong amount or charged after cancelling, write to us with the receipt and we will sort it out with the store.

7. Couple compatibility and invitations

The couple feature compares two charts and two temperaments. It only works if both people accept the link, each in their own account, and it only shows what the feature describes. It is enough for one of the two to have Plus to see the full screen. Either person can remove the link at any time, and the shared data stops appearing.

Invite only people you know and who agree to receive the invitation. By accepting, each person also accepts that the other sees the data described in the Privacy Policy.

If there is a referral benefit, such as Plus days when someone completes sign-up through your invitation, it has the limits shown in the app. We may cancel benefits obtained through abuse, such as fake accounts or accounts created only to earn the benefit.

8. What you agree to do (and not do)

By using Quintessa, you agree to:

• use the app only for your own self-knowledge and the personal use provided here;
• not enter other people's data without them knowing and agreeing (for example, someone else's birth data to read their chart);
• not try to access other people's accounts or data, nor get around access rules, limits or the Plus paywall;
• not reverse-engineer, scrape in bulk, automate the use of the app or overload our infrastructure;
• not resell, sublicense or present as your own the content, interpretations or calculation engine of Quintessa;
• not use Quintessa to discriminate, harass or decide on hiring, credit or any matter where an astrological or temperament profile should not weigh.

9. Your data, your account

The data you enter and the results generated for you are yours. We only use what is needed to run the app (store, calculate, show back to you and send the tip), as described in the Privacy Policy.

You can export your data in your Profile, under “Export my data”, and delete your account under “Delete account”. Deletion erases your chart, questionnaire and tip history, and cannot be undone. Retention periods and exceptions are in the Privacy Policy.

The images you generate when sharing a result or a tip are yours to share, and carry the Quintessa brand.

10. What is ours

The app, the calculation engine, the interpretation and tip texts, the design and the Quintessa brand are ours or licensed to us. You get a personal, non-exclusive, non-transferable and revocable license to use the app while your account exists. When the account ends, the license ends.

The app uses third-party material under free licenses, credited on the “About” screen: the city database is from GeoNames (CC BY 4.0) and the astronomical calculations use the astronomy-engine library (MIT).

11. The honest disclaimer

Quintessa is a self-knowledge and entertainment tool. Astrology and the theory of the four temperaments are historical and symbolic traditions and have no scientific proof. The tips are reflections inspired by those traditions, not predictions, and they don't guarantee any outcome in relationships, work, money or health.

Quintessa is not medical, psychological, legal or financial advice, and does not replace a professional. Don't make important decisions based only on a tip. If you are going through emotional distress, seek professional help. In Brazil, the CVV answers 24 hours a day on 188.

The chart calculations follow astronomical data and are checked by tests. Even so, the result depends on the data you entered: without a birth time, the ascendant and houses are estimated.

The service is provided “as is” and “as available”. We work to keep it running and correct, but we don't promise freedom from faults or interruptions.

12. Limitation of liability

To the extent the law allows, Quintessa is not liable for indirect damages, such as lost opportunities or frustration with the content of a tip, nor for failures caused by third parties beyond our control, such as app stores, your carrier or the internet.

Nothing in these terms excludes or limits rights that the law doesn't allow to be waived, in particular those of the Brazilian Consumer Protection Code, nor our liability for willful misconduct or gross negligence. If any part of this clause isn't valid where you live, the rest still applies.

13. Suspension and termination

You can stop using Quintessa whenever you want: cancel the subscription in the store, delete your account and take your data with you.

We may suspend or close an account if you:

• violate these terms;
• use the app for fraud, harassment or illegal acts;
• abuse our infrastructure or the referral rules;
• provide false information at sign-up.

If we close your account for one of these reasons, there is no refund for the period already paid, subject to your legal rights. If we close it without cause, for example if we shut the service down, we give at least 60 days' notice, give you the chance to export your data and guide you on how to request a refund of the unused subscription time from the store.

14. Service changes

We may add or remove features, change prices and change how the app works. For significant changes, especially price changes for current subscribers, we give at least 30 days' notice, and the store follows its own rules to ask for your confirmation when necessary.

15. Governing law and venue

These terms are governed by the laws of Brazil. As a consumer, you may bring claims in the courts of your place of residence, as provided by the Brazilian Consumer Protection Code and, outside Brazil, to the extent your local consumer law requires.

For anything about these terms, your account or requests about your data:

We reply to most messages within 2 business days. Requests about personal data, within 15 days, as the LGPD requires.

17. General provisions

• Entire agreement: these Terms of Use and the Privacy Policy form the complete agreement between you and Quintessa.
• Invalid parts: if a part of these terms is found invalid, the rest still applies.
• No waiver: if we don't enforce something once, we can still enforce it later.
• Assignment: you can't transfer your account to another person. We may transfer this agreement if Quintessa is sold or merges with another company, with notice to you.
• Headings are for navigation only and don't change the meaning of the clauses.
